These general terms and conditions of sale apply to all orders placed on the website www.france-ventilation.com. The applicable terms and conditions are those in effect on the day of order validation.

Our product offers and prices are valid as long as they are visible on the website.

Any purchase order signed by the consumer with a “Click of the checkbox” constitutes an irrevocable acceptance that cannot be called into question except within the limits provided in these general terms and conditions of sale. The “Click of the checkbox” associated with the authentication and non-repudiation process and the protection of message integrity constitutes an electronic signature. This electronic signature has the same value between the parties as a handwritten signature.

You can make payment by:

• Credit card
• PayPal (To use this payment method, you must have an account with PayPal. If you choose to pay by PayPal, the PayPal terms and conditions apply.)
• Bank transfer, in this case, you manually make the transfer through your banking application or with your advisor.

France-ventilation.com reserves the right to refuse to deliver or fulfill an order from a consumer who has not fully or partially paid a previous order or with whom a payment dispute is being processed.

France-ventilation.com conducts fraud checks on all orders placed on its website. As part of these procedures, our services may request any necessary documentation to unlock your order. The information provided in the order form is subject to automated data processing. In accordance with the Data Protection Act of January 6, 1978, you have the right to access, rectify, and object to all of your personal data at any time by writing, by mail and providing proof of your identity.

All stated deadlines are calculated in working days (subject to validation of your order). The delivery date is calculated taking into account the preparation and shipping times, plus the carrier’s delivery time (La Poste, DPD, TNT, UPS). The products are delivered to the delivery address you provided during the ordering process or to a pick-up point. Delivery is only available in Metropolitan France, Corsica, DOM-TOM, Belgium, Italy, and Switzerland.

France-ventilation.com shall not be held liable for the non-performance of the contract due to the occurrence of a force majeure event. Regarding products purchased to meet professional needs, France-ventilation.com shall not incur any liability for any indirect damages arising from these terms, loss of business, loss of profit, damages or expenses that may occur.

In order to process your request properly, please provide us with your order number and complete contact information. For practical details on how to make a return, please contact us by phone. In accordance with Article L.121-20 and following of the Consumer Code, you have a period of 14 working days (unless a longer period is specified in the product descriptions) from the date of delivery of your order to return any item that does not meet your expectations, in its original packaging and in good condition, suitable for resale, and request an exchange or refund without any fees, except for the return costs.

In accordance with the provisions of Article L121-20-2 of the Consumer Code, the right of withdrawal cannot be exercised for:

• Services whose execution has begun, with your consent, before the end of the 14-day period.
• Goods made to your specifications or clearly personalized, or which, due to their nature, cannot be returned or are likely to deteriorate or expire rapidly.

• All products are guaranteed for 1 year unless otherwise indicated on the website (manufacturer’s warranty).
• The warranty is reduced to 6 months for professional use of our products.
• Our products are intended for residential use.

If you are experiencing an issue with your ventilation:

With the optimal warranty, for a period of 30 days after receiving your order, we commit to accepting the return of any product that does not meet your expectations and offer you an exchange or a refund. If the exchanged product is more expensive, you will pay the difference, and if it is cheaper, we will refund the difference.

1. Contact us by phone or email.
2. We listen to your request. Return for exchange or refund.
3. We will provide you with a prepaid shipping label to return the product to us at our expense (subject to acceptance of your equipment after pre-diagnosis).
4. We will replace your product within 30 days between your return and our reshipment, or we will exchange it or refund it.
5. We will reship the equipment at our expense.

Please note: For returns intended for a refund, the equipment must be new, clean, and in its original packaging. Shipping costs are non-refundable.

If it is necessary to replace the product with another brand, the purchase price on your invoice cannot be exceeded.

Valid only once per order.

You want to return, exchange, or get a refund. You have a period of 14 days for returns, exchanges, or refunds, and a warranty return period of 2 years from the date of receiving your item.

1. Contact us by phone or email.
2. We will perform a pre-diagnosis of the issue with your item over the phone, if necessary.
3. You will return the product to us at your own expense (subject to acceptance of your item after the pre-diagnosis).
4. We will repair your product within 15 days from the time you send it to us, or we will exchange it or refund you.
5. If necessary, we will return the item to you at your expense.

Note: For returns intended for a refund, the item must be new, clean, and in its original packaging. Shipping costs are non-refundable.

In case it is necessary to replace the item with another brand, the purchase price on your invoice cannot be exceeded.

At any time, “you have the right to access, modify, correct, and delete the data concerning you (Art. 34 of the ‘Information Technology and Freedom’ law of January 6, 1978). You may also choose to refuse to receive future newsletters and special offers from France-ventilation, which will be sent to you upon your first order, by clicking on the link located at the bottom of the newsletter.”

In the event of a dispute, the Commercial Court of Toulouse (31) shall have exclusive jurisdiction, regardless of the terms of sale or accepted mode of payment, even in the case of warranty claims or multiple defendants. The issuance of bills of exchange does not constitute novation or derogation from this jurisdiction clause.
